These Terms & Conditions (“Terms”) govern use of UpdatePHP at https://www.updatephp.com (the “Site”), including free tools, registered accounts, Site Manager, trials and paid Pro access. By using the Site or creating an account you agree to these Terms and our Privacy Policy.
Some features require a registered account. You must provide accurate registration details and keep your login credentials secure. You are responsible for activity under your account, including actions by team members you invite.
Site Manager lets account holders manage a portfolio of sites, clients, contacts, probes, rescans, reminders, analytics and (where enabled) agency branding and team permissions. A free trial may provide time-limited access to Pro features as described on the Site. Continued unlimited Site Manager use after the trial requires a paid Pro license or subscription as offered at the time of purchase.
Paid Pro access is purchased through the Site. Payments are processed by Stripe. By completing a purchase you also agree to Stripe’s applicable terms for payment processing. UpdatePHP does not store full payment card numbers. Prices, billing intervals, discounts and what is included in Pro are shown at checkout or on the pricing pages and may change for future purchases.
Unless required by law or expressly stated at purchase, fees are non-refundable once Pro access has been granted. If billing fails or Pro lapses, Site Manager access may be limited or suspended until payment is resolved.
You retain ownership of data you upload to Site Manager (including client and contact details). You grant UpdatePHP a limited licence to host, process and display that data solely to provide the service. You confirm you have the right to submit that data and to invite team members who can access it. You must not use the Site to store or transmit unlawful content.
PHP scanning and related checks (including scheduled rescans and probe-assisted checks) are provided for hosts you are authorised to assess — for example as the site owner, administrator, hosting customer or with permission from such a party.
By using scanning features you confirm that you:
Scanning results are provided for informational purposes only and may be incomplete or inaccurate.
Material and services on the Site, including scans, alerts, Site Manager and Pro features, are provided without guarantees as to accuracy or uninterrupted availability. To the fullest extent permitted by law, UpdatePHP and its suppliers exclude implied warranties and shall not be liable for any direct, indirect, special, consequential, punitive or incidental damages, or damages for loss of use, profits, data or other intangibles, arising out of or related to use of the Site or inability to use it, whether in contract, tort or otherwise. This does not affect liability for death or personal injury arising from negligence, fraudulent misrepresentation, or any liability that cannot be excluded under applicable law.
The PHP scanning and Site Manager features are provided “AS IS” without warranty of any kind, express or implied, including but not limited to merchantability or fitness for a particular purpose.
You may link to our home page in a fair and legal way that does not damage our reputation or suggest endorsement where none exists. You must not frame the Site or deep-link in a misleading way. We may withdraw linking permission without notice.
Except where stated otherwise, names, images, trade marks and third-party products mentioned on the Site are not affiliated with UpdatePHP. References are for identification only and do not imply endorsement.
You agree to indemnify and hold harmless UpdatePHP and its directors, officers, employees, consultants, agents and affiliates from third-party claims, liability, damages and costs (including reasonable legal fees) arising from your use of the Site, your scanning activity, data you store in Site Manager, or your breach of these Terms.
We may amend, remove or vary the services and pages of the Site, including free, trial and Pro offerings. Material changes to these Terms may be posted on this page; continued use after changes take effect constitutes acceptance where permitted by law.
If any part of these Terms is unenforceable, the remainder stays in effect. Where possible, an invalid clause will be interpreted to match its original intent as closely as the law allows.
If you breach these Terms and we take no action, we may still enforce our rights in other situations.
These Terms are governed by the laws of the United Kingdom. Disputes relating to these Terms are subject to the exclusive jurisdiction of the courts of the United Kingdom.
